OK people, do you know why this was struck down? Because it is not as simple as: bad crime = kill them.....

I am not talking about the normal death penalty argument.

A few points one might want to think about,

one... if someone rapes a child, and then is killed for it, what will that do to the child who has already been raped? Will the skrew the kid up the poor kid even worse because they cannot confront themselves? Will the death of the rapist compound the already traumatic event?

two... What if the rapist is a family member? If someone's brother is a sick fuck and rapes a kid of theirs, would it be right to kill them considering all of the family feelings tied into the trauma? Would that not make the issue at least debatable?

three... Lets say it is a stranger who is the rapist, and now because of the fear of punishment, he has turned from a child rapist into a child rapist/child murderer, for fear that he might get caught, and therefor doesn't want to leave witnesses? I know what you are thinking here, that if he is sick enough to commit the act and not be afraid of the prison time to begin with, why would he then be afraid of death? Well to a lot of people death and a life in prison are like night and day...

Not saying that these things would apply in every case... but it is what complicates the issue.

Personally, I should like to see them kept alive, and studied for whatever psycho-neurological data could be gleaned from them about how to spot indicators early, and how we might begin to treat these problems. Of course, I'm referring to simple things like mandatory therapy and counseling, drug tests and involuntary MRI scans, etc.

What makes the difference to me, here, is that the ruling wasn't on child molestation---it was on child rape. I don't care if you ARE a relative--hell, if you are a relative, doing this to your own, in my mind that's WORSE than a stranger. If you rape a child, i think death would be a just punishment. I do think, however, that like murder death penalty cases, that the death penalty should be used on only the worst cases of child rape. As in, not for the 18 year old cousin who got in trouble with the 14 year old cousin, but for 53 year old uncle George raping 7 year old Jill. Death is decided seperately most often in murder cases, it should be a special consideration in the same way for these cases. The option should be open.

Things like this are often already done.

Even if these things *could* be spotted early, it would still be a matter of the person voluntarily getting treatment. Until they commit a crime, they cant be compelled to do anything. Hell, even the ones that *have*, unless they want to stop, mandatory therapy wont do jack squat.

I am so mixed on this. I support the Death Penalty for murder and high treason. I don't support it for rape, of any kind. I know rape is a horrbile crime... and rape of a child is even worse... but I dont think rape is as bad as murder.

A raped person can live a normal life (most likely not as good as it would have been if they had not been raped) where as a murdered person gets to slowly rot.

Then, throw them naked in a maximum security prison.

Ooohhh yeah...in prison? Baby rapers are in the number one spot for hourly beat downs and rapes. I've heard stories from friends that did hard time, not pretty stuff.
