drinking and driving and getting arrested-

i know someone who after drinking and driving they claim they got arrested (this would have been some time after midnight) and by early a.m. (before 5) they said they were "bailed out".

is this even possible? i thought if you were drinking and driving and arrested, they made you stay the night at least? this is what i was told by others anyways. i have no idea about any of this as i would NEVER be drunk and then drive.

and what is the process after? do you lose your license after that offense? does it take more offenses to lose your license? does it get suspended or nothing at all? do they leave your car there? impound your car? are there fees your first time you do this?

i am asking all these questions just to see if this person might not be *lying* a bit ;)

I don't know any of the minor details, but I do know that MI's really cracking down on drunk drivers nowadays. I do know that there are a crapload of fines to pay, which I heard can total up to $6,000. I heard that you also have to pay a hefty fine to get your license back.

Sorry that I don't know the particulars. Hopefully someone on here knows more than I do.

I know someone who had to spend all night...couldn't get her out till the next day

Probation and lost her lisence for a few months 1st offence and it was a long time ago

Yeah, I think this person is blowing smoke up your ass..

I've NEVER known anyone to get out THAT NIGHT for any DUI or possession offense, unless they were a snitch for the cops.

also not sure if this matters but it would have taken place either in oakland or macomb county

Also, since it is a holiday weekend, they'd be locked up until Monday. There are no judges when court is closed, today they are closed.

Good point, Miranda..

You're ABSOLUTELY correct on this.

Two of my uncles were notorious drunk drivers, that's why I know all of this. I rarely even drink, and If I did, I'd never drive. One of my uncles had 7 D.U.I's, he went to prison for it, and he has stopped, finally. The other had 3 D.U.I's.

They take your car 9 times out out 10, especially if you are alone, 100% for sure they will in that case. It's up to the cop really what he wants to do. If there is a sober person in the car and he feels especially nice, he may let them drive the car for the person. If alone, it will be impounded.

Now on your first offense , you lose your license when convicted. Fuck yeah there are fee's , first time offense court fees are well over 10,000 now. That's why they now call it "The 10,000 Ride".

oh yes, also this person was alone and it would have been their first offense (as far as *i* know)

Now, here's the big question: Why would someone lie about getting a D.U.I? :) If you can say, no problem if you can't. I assume maybe they were trying to make an alibi for time they may have been missing or supposed to be elsewhere?

they were saying it (if lying) to make me feel guilty ;)

Haha damn! Busted. :p Also, they should have their ticket. I dunno how he thought he would be able to get away with this. Not with the DGN crew on his ass.

haha. i don't know about the ticket or not. i was going to ask to see it if they made an issue about it again. but i don't see them that often so i don't know that if i will get to do that.

here's the deal- they were really drunk and wanted to come to my house. i said no way. they showed up anyways, so i did not answer the door. if i say "don't come over" i mean it. so then i texted them and told them to sober up and then leave. well, they left right then. i assumed they MUST be ok if they drove all the way to my house in the first place and then left when i said to. but then to get a text saying they just go bailed out of jail 5 hours later.... sounded weird to me!

they are claiming they had a "friend" who helped them get off. the friend "was a cop and is now a fire fighter".

so if you know someone on the "inside" you get off THAT easily? really? just arrested and bailed out hours later? from what i understand they were pretty damn drunk too. not just a little buzz/over the limit. like throwing up, seeing "triple" (they said), drunk.

At least they leave the drunk walkers alone,I have yet to see them impound my shoes for that.

let alone I do not drive drunk anymore, now walking drunk I get away with it all the time.

Yes it happens. Usually if your dad is a cop...doubt if he would stick his neck out for a friend of his kid who he thinks a bad influence....

I have known two people who get away with anything short of murder...but it has to happen IN THAT TOWN. The one they live and work in.

(they know judges as well)

well this friend is a person that they went to grade school with. it is not like they are even friends NOW (to my knowledge) they just were back then. seems odd to me. and i'm still not buying it. ;)

i asked specifics - where's the car, how much was your ticket, what jail etc etc and no answer on the ticket and they have their car. would the cops just leave their car where they "arrested" them from or would it get impounded for sure?

i know i am asking a lot (to you guys) for what seems to be no good reason but believe me i have my reasons.

this all seems skeevy to me.

You can get bailed out right away depending on the city you live in. When I got arrested my mom bailed me out less than two hours later. It was in Madison Heights. But you best bet if we were one city over, in either Royal Oak or Warren because they're equally dicky, we probably would have been held overnight.

I was also arrested on Easter Eve, so not only was it a Saturday night but a holiday the next day. So the thing about not being able to be bailed out until Monday "due to a holiday" is crap. You don't need a judge to be able to post bail.

But some cities have wait limits and policies to keep you in at least overnight. Trust me, Raven and I are walking law books, we should be lawyers .

Don't EVER think that our judicial system even gives a LITTLE BIT of a SHIT that you're either "punished" or "rebilitated". To them it's ALL about the Benjamins and that's IT! They don't care about justice, just dollars, welcome to America. So in most cities if you're able to post bail then you're able to leave, simple as that, since they only care about the money.

they tell me it was in warren, not where they live though.
