Having a copy of the Constitution,and the Bill Of Rightsin your vehicle may help you alot if you happen to get pulled over at any givin time for no apparent reason.A good friend of mine had these documents with him when he got pulled over and the pig that stopped him could not do a thing.does anyone here have these? just wonderingwith alot of our rights being infringed upon having these might help,even though its not a 100% gaurentee you wont get fucked with.

i've been pulled over a few times, random checks, nothing serious, and once when i scared a copper doing over the limit in the fast lane without any blues (and he was going well over 100).

nah. i jjust got out of my car on a busy straight in the freeway and walked over to his car.

that way they cant ask to see what was in my trunk. that would have seriously put the cat among the pidgeons

You walk up to a cop car in this area and don't stay in yours... you can get shot....

Yikes .... that's all kinds of wrong here. *If* you don't end up shot, they will no doubt throw you in jail or ticket you for direspecting an officer of the law (or whatever law they can file that under).

I display a copy of the Constitution complete with all 27 amendment on my wall, I also have them on the outside of my locker at work held up with a bumpersticker that says...

I'm considering keeping a copy in my car for the kids but I don't need it for being improperly pulled over, read on.

I know my rights and I don't have to yield those documents to you until you tell me why you pulled me over.

Well let me tell you something, thinking something and knowing something are two different things. You have just admitted to pulling me over with no just cause and because as soon as your lights flashed I dialed my house to record our conversation you're going to get back in your car and drive away so I can go home and erase my answering machine or I'll call my lawyer right now.

If he had said "I recognized you and ran your name, you are driving on a suspended" then I would have handed him the docs, called my lawyer and been hit by Michigan's triple jeopardy.

normally they want you out of a vehicle here and in the back of theirs while they talk to you, so you cant do a runner.

but yes i do realise in the states they approach you

In Michigan, the law is referred to as Implied Consent when it comes to presenting your license and registration.

By HAVING a drivers license, you have agreed to present it whenever requested by a member of law enforcement. If the officers want to be a pain in the ass then the following -

You have just admitted to pulling me over with no just cause and because as soon as your lights flashed I dialed my house to record our conversation you're going to get back in your car and drive away so I can go home and erase my answering machine or I'll call my lawyer right now.

That can get you into some pretty big trouble, if the officer remembers the whole Implied Consent thing.

By being granted the privilege to drive in Michigan (remember, it's NOT a right), you have agreed to comply with the officers of the law. You can check that with your lawyer too if you want. I had to once :(

Your recording would do more damage to you than good. Also, the majority of cruisers in Michigan now from city to city are equipped with dash cams and mics. Officers have no access to what their cruisers record. If you are being pulled over, you are already being recorded.

Additionally I'd like to point out what a patrol supervisor friend of mine once told me.

"Usually, if someone is being cool with one of us we just talk to the person and give them a warning unless the local law forces us to issue a citation. Even then, we usually give the citation for the lowest offense - such as 5 over when we both know you were doing 15 over. Now when someone wants to give us a hard time or be a smart ass...they get no breaks from us."

Gotta agree with ya raev..

but ocasionally... you have those assholes that just want to harass you... USUALLY my encounter's with cops have been cool. And every time it's been a cool encounter, I knew already why I was being pulled over, and wouldn't even try to bullshit them. Now when i get those funny blinking lights behind me and I don't know why.. then i'm on my defences, but still assertive, and every time I honest to god don't know why they nailed me, it's usually needless harassment. For a while I had a legal insurance, for a very affordable price (under 10 dollars a month) I could have a lawyer at my disposal at any time I needed.

This also came with a business card that the insurance agencies highly reccomended to present with the proper credentials every time you had an encounter with the law. Being in NC at the time, cops there usually outside the immediate area where most marines were stationed, would go out of their way to give marines harassment issues. Twice I've been pulled over for no reason in that state (while driving home on leave) and would flash them nothing but that card as soon as they came up to the window.. one cop handed it back and just said, "have a good day" another got froggy about it. I can't remember the fight exactly, but It was obvious that he was just looking for an excuse to pull me over after he did (my car's maintinence was up to par, i wasn't speeding, and my license plate was up to date and valid. I refused to give him my credentials until he told me why he pulled me over. He said to give them to him anyway so he could find a reason. At that time I told him I memorized his badge number and would be calling my lawyer if he doesn't start doing his job correctly that moment. It was 15 more minutes of harassment, him swearing at me, threatening me with arrest.. but I played calm and said, dig yourself further... that's legal insurance, so it aint gonna cost me anything to get a lawyer with all this. His face turned beat red and threw the card back at my face and drove off..

I am always extremely uneasy when it comes to encounters like this. Yet as long as i stay calm and tactfully state my rights and with the card, show I have teeth that can really hurt them, I would manage to defend myself against this sort of treatment. I'm not gonna just roll over and get fucked by the law for not doing anything, I've always been one to stand my ground

So in this thread, you basically just admitted to driving around without a license, denying an officer your license, and threatening an officer with unjustified legal action. Good job sparky.

Those of you with a copy of the Constitution and Bill of Rights in your cars, maybe you should consider adding a copy of the Michigan Statutes.. they're the laws you should be worried about.

The problem with the "they can't do that" approach to dealing with law enforcement is, well, yes they CAN. While they have you pulled over there at the roadside, and especially once they haul you off somewhere, they can do whatever they damn well please. Now, if you are indeed legally in the right, and can afford a lawyer to back you up on that, the officer(s) MAY face consequences for their actions, and you'll get to go home. But in the meantime, you're still gonna spend at least a few hours locked up, and possibly beaten up, too. So unless you know you're gonna get hauled off anyway (due to warrants or whatever) and therefore have nothing to lose, it's usually more productive to just smile, be cooperative, and try real hard to suppress your negative feelings toward officers of the law. In this situation, positive paraverbals are likely to do you more good than ten copies of the Constitution.

Have heard horror stories of cops who terrorized people that have sued them,IMO when you sue a cop and the dept, you might want to stay out of that city for good.

running your mouth about the constitution and bill of rights is a good way to get your name on a list of suspected militia members or tax protesters here in michigan.
