My daughter was born today. My soon to be ex wife, or a member of her family didn't call me like the court ordered her to. I didn't get to be there when she was born. There was a message on my parent's answering machine after the fact saying that she had been born today. The court order states "will call cell phone on the way to the hospital." I recieved no such call.

There are ramifications for violating a direct court order that way. You should file a complaint immediately.

It won't solve the situation, but it could make her think twice in the future. If you let this go without action it could cause her to do worse in the future as far as visitation, etc. I let a lot of things go I should not have and in the end it's more trouble to try to sort it out later.

Tell that to my ex who had me jailed 2 weeks after the birth of my third child (for failing to provide my oldest daughter for visitation ... completel bull crap - he never showed). I got out of actually serving jail time ... but the contempt of court charge is still on my record.

She violated a court order! Trust me, if MY ex did something against the court's wishes, you bet your ass I'd make him pay. New mother or not, she violated the order. Tough shit on her. She's old enough to know what a court order is.

Well, i don't like people to get sent to jail so flippantly. Sure, she's a complete cunt for what she did... but putting her in jail right now is punnishing the baby more than her. That just isn't isn't right in my book.

And I'm not sure why people can't just leave it at "congratulations" instead of making this into oh she's such a cunt and a bitch and blah blah blah. I've not talked to her in a year or so, but it's not fair to her to be outing her on a public message board when she's not here to defend herself.

Do I think she's right? No. Do I think she should have called or have someone else call? Yes.

Wow! Your a daddy! Hey, at least you wanted to see her. I know some guys who don't know or care where their offspring are.

Enjoy every precious moment you will get with her. They grow up real fast!

I personally think it was out of line not to call you wether or not there was court order. I do not know the in and outs but since there was court order i would think it might be wise to make mention to atleast your lawyer that you were not called. There is a child invovled and perhaps the lack of contact could cause for the child to be hurt latter in life when she can process that DAD was not there but not the reasons why. Perahps Jail time may not be suitable right now but i do think the matter does need to be addressed. I would only hope that from now on you both look out for the best intrtest of Your baby girl and not your own agendas.

Oh yeah :happy: i also give you allot of credit for wanting to be there and caring weather or not you were or were not. One of the deffinitions of a REAL MAN in my eyes.
