Early this mornning @ 1AM on January 17th, 2005. I was driving on 275-S to 696 W. I noticed I was speeding so I slowed down, than should apear The State Police gumball machine beacon of Red. So, I pull over and roll my window down and the officer shines light into my car and tells me to put my hands out the window. Than instructs me to put my hands on my car, so put them on the roof of my car than he pushes me down to hood my car and seaches me. Than he tells me put my hands behind my back says, your aristed for Reckless driving. Dosen't read me my moranda rights. Do I have anyone can post a bond for me tonight. I said yes, I do. And tells me get back of the cop car. And than instructs his partner check my car for any dents. Mind you I have old 1987 Pontiact 6000 for rust and dings. Then he said do have anyone post bond again but, this time for $100.00 said, I do. But, not sure how much money is my bank acount off hand. So, we drive off down 275 S towards 696, and he asked me about my learning disblitys, my family and my witches heal bumpsticker and ask me do I actualy belive in that stuff. I said yes I do, he just rolled his eyes when asked me that. Than he asked me for my proof of insurences I said, said yes in my glove box. Than he asked about my old address in monroe, and if know anyone lives there said that's my old address, and asked me about my Royal Oak address said just moved to Farmingto Hills. So, than after all that was over he said I am going release you under your own acondses, and lets me go on Orchard Lake Rd and 12 Mile Rd. I walked home. So, now I have pick my car up at the impound for $110.00 and wait for hearing date and got two tickets a civil afercaton and mistermeaner. Oh, joy..for me :erm . So, I belive I was profile becasuse there more to it, I can tell you about it, just wanted sum it up what all went on.

they dont have to read you your "Miranda" rights unless they arrest you and then decide to question you. He just took you into custody and cited you for wreckless driving etc., so there was no need to Mirandize you... had you in the conversation admitted that you just killed a 6 year old for a Wiccian sacrifice or somthing, he would have placed you under arrest and then read you your miranda rights before you got a chance to spill anymore information that would be usefull in an investigation.

They aritsted me and put me in cop car and was going take me to jail for the night.

Did they ever actually say "Your Under Arrest". If not, then you were not arrested. If they had arrested you, they could not just let you go on the street. They would have had to print you and take a picture... the whole booking process.

The questions about your addresses are perfectly legit... You have to do a change of address within so many days of moving.. depending on where you live, the ticket for not doing it is upwards of $100 but usually around $40.

BTW.. Cops are allowed to make small talk... they are people too. They are also allowed to have thier own opinion about your beliefs and/or life style.

I feel like got profiled..and he said people with Depresstion shouldn't never be on the road. Asked me about my depresstion and alot personal questions. Made me feel uncofterable asking.

That's very true! I'm associated with many officers in many cities so I've got to learn a lot about how the law works.

If you think that's bad what happened to you, I could tell you some really fucked up shit some cops have pulled. Sorry that happened to you though.. Sounds likes they were just fucking with you because they have been known to do shit like that.

CEotW said that the police actually loaded him up in the car. Typically, unless they're being unusually civil and giving someone a ride, this usually addes up to an arrest of some sort. Why would they put you in the car, get the tow yard to come and get your car and then just drop you off in the middle of nowhere? Makes no sense.

I would be seeking legal counsel, first of all, if you can afford it and stay away from the "if you cannot afford an attorney, one will be appointed for you" deal. Second of all, most likely, the cops will most likely not show up. This will go well for you, if it's the case. I have several friends whom I've encouraged to show up at court for small fine tickets (seat belts, minor speeding violations, etc) and *very rarely* do the cops ever show up to contest.

Make sure that prior to the hearing you submit in writing a formal request for a copy of any and all tapes/recordings of the incident from the police vehicle. If you can prove on those tapes that you were in no way, shape, or form a threat either driving or in person than you may have a harassment case. According to your account you were cited with reckless driving. Were you driving recklessly? If you say you were not and their tape can prove that you were not, then they had no cause to remove you from your vehicle. What is your criminal record like? If they ran your plate, pulled your license, etc would they have a reason to believe that you may be a danger to yourself or others?

I have never been aristed in my life. I got clean driving record. Said I was going to fast. I slowed down when noticed I was going to fast. I never comited any crime in my life. My parents are geting me an atorney for me. I got my car out the impound lot yesterday. :tear , felt like shit all day yesterday I wrote down all the stuff went on a Microsoft word document.

275 ends at 96/696 West. There's no possible way to go south on 275 to 696W, or 96W for that matter. You COULD go south on 275 to 14 west, and if you were doing 85 on the ramp, you'd probably be pissing off the police.

Actually, the reason I get out of tickets is because I flash the cops some tit and they let me off! (j/k)
