This is an OUTRAGE, and a travesty against the Constitution. I'm so mad I could spit fucking NAILS because of this.

Anyone who isn't incensed by this can go live in a Third World country.

Is it really such a hardship to answer one or two questions instead of giving someone just trying to do their job a hard time? I'm sure she doesn't like having to stop ever care either and asking the same things over again. Unforunatly thats one of the realities in this country now, and I don't like it either, but I was at least raised to respect people of authority. The guy would have probably been in and out of that check point in 30 seconds if he would have just answered her questions. Illigal immigration is a problem in this country, the border patrol is just trying to do their jobs. Under the 100 mile rule, they are well within their rights to set up a check point there.

..but not to ask questions with no suspicion..that's tantamount to illegal search & seizure.

It's the same exact thing they do at the border. Maybe it's just me but I have nothing to hide so I don't really give a shit if people as questions, and IMO no person should care if they ain't hiding anything. Being a complete dick at the check point is the reason shit takes so long.

I know my rights, but I still think it's completely retarded to act the way that guy did. I also don't live in fear, but I will answer a few yes or no questions if I have to. It's called common sense, if you're not hiding anything why raise holy hell to just make yourself look like an ass and hold everyone else up?

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

IMO being asked a few simple questions is not violating any rights under the 4th amendment simplely because I don't see being asked anything an illegal search, especially in this situation. The guy was in his car for christ sakes. Yes this country was built by the strong but it was also built by those who knew how to show common courtesy and respect for authority.

there is actually a very good point brought up in one of those replys on the site where the video is. Someone mentions that they would like to know what questions would have been asked after "what country of origion are you from".

While I think the question might have been worded better....this is the same basic question given on applications....

I see no rights violated....I see some guy in a car being a dick before being a dick would have been called for.

I only have one point to make.

Border searches need neither warrant nor probable cause.

They need probable cause to do a cavity or strip search.

It's been upheld in court.

He was doing it to prove a point to US citizens that we don't have to put up with our rights violated. It was at the checkpoint, apparantly, that allowed this to happen:

"Edgar Ayala, a Forks High School athlete who graduated with honors in June, was arrested on August 20th at the Border Patrol checkpoint and deported to Mexico."

So basically, they deported a girl to Mexico who was of Native American decent and they had absolutely no proof what-so-ever that she was an illegal immigrant. Says she graduated last June...so you're telling me I should be for Border Patrol stopping a young, what I'm assuming, 18 year old girl who is fully an American citizen so that she may be dropped off in Mexico, ON ASSUMPTION, to be possibly raped and/or killed (Mexico not being as friendly as Disney Land from my understanding)?

Damn...that's crazy. Sorry, but I'm not for that. What I'm all for is taking the Constitutional RIGHTS (not priveledges) of American citizens and rubbing them in the authorities' collective noses as hard as I fucking can. Anyone who claims less, I'm assuming, doesn't give two shits about their freedoms and rights, that's what that tells me.

I wasn't even talking about the girl who got deported, which I agree should not have happend. My main point is that the guy shouldn't have been such a jackass and getting asked a few yes or no questions is not a violation of anyones rights. He was proving no point other than he didn't care that people are just doing their jobs, which everyone seems to forget. The border patrol agent is just doing her job, and most likely gets treated like shit by ignorant people her entire shift. What's wrong with showing some respect for people? I think thats something lost on this country these days.

True, but were they blatently acting like complete assholes and video tapeing it just to get their 15 minutes of fame? I mean really he can't even say she violated his rights when he didn't even allow her to get a question out. They main point I'm trying to make is don't take it out on the person just doing their job, you got a problem with shit like that take it up with the people who made the decision. Edgar Ayala was a BOY, not a girl. He was born in Mexico and came here when he was a baby with his mother. He was an illegal alien, just like his mother. He now lives with his father in Mexico.

as for the checkpoint...

as an american citizen, i would be V E R Y unhappy about being stopped and questioned by the border patrol. btw, detroit is within 100 miles of the US border. if the standards being applied in washington were adopted here, anyone who lives in metro detroit could be questioned at any time by the border patrol. if the border patrol has reason to believe that there is something illegal happening at a certain time and place, then by all means they should investigate. i may not fully agree, but that's the law. SUSPICIONLESS checkpoints are a different story.

that said, the guy who made the video could have said the same words politely and proved his point just fine. instead, he came across as a combative belligerent asshole.

I was wondering the same thing myself. I would say if it was on the mexican border that the guy could probably be arrested for the video taping the border agent cause of the securuty risk.

After that time, the police either have to file charges against that person, or release them. If you're a dick to a cop, they can hold you for 24 hours of your life that you'll never get back and there's nothing you can do about it. Now, they can't arrest you without cause, but they can detain you. Not much of a difference except semantics and legality.

But you must be informed that you are being detained... if you are... you get certain rights as well...
